Please read these Terms of Use, our Privacy Policy, and our HIPAA Policy (collectively “Terms of Use”) before using the Websites or DPid’s services. By visiting the Websites and using DPid’s services, you agree to these Terms of Use as a binding legal agreement between you and DPid without limitation or qualification. If you do not agree to these Terms of Use, then you may not use these Websites.

DPid reserves the right at any time and without notice to change these Terms of Use simply by posting such changes on the site. Any such change will be effective immediately upon posting. You agree that each visit you make to the site shall be subject to the then-current Terms of Use.You agree to periodically re-read these Terms of Use so that you are aware of any changes to the Terms of Use.

By continuing to use the Websites, now or following any modifications to the Terms of Use, you confirm that you have read, accepted, and agreed to be bound by the Terms of Use and any such modifications. Restrictions on Use of DPid Materials

The Website, including, but not limited to, the text, content, photographs, images, video, audio, graphics, and any software (including data or images incorporated into, generated by, or accompanying the software) available on or through the site or contained on the site (“Materials”) are owned and operated by DPid. The Materials are protected by copyright, trademark, trade secret, domain name, patent, and/or other proprietary rights and by federal and state laws. Unless otherwise indicated on the Websites and except for the trademarks, service marks, and trade names of other companies and/or organizations that are displayed on the Websites, all trademarks, service marks, and trade names are proprietary to DPid. You agree to abide by all applicable intellectual property laws and any additional notices or restrictions contained on the Websites. You acknowledge that unauthorized use of the Materials or modification thereto is a violation of DPid’s trademark, copyright, trade secret, and other proprietary rights.

Except as provided in these Terms of Use, you may not copy, reproduce, republish, upload, post, transmit, or distribute the Materials in any way.You may not access the Websites manually or with any robot, spider, web crawler, extraction software, or other automated process or device to scrape, copy, or monitor any portion of the site or any Material on the Websites.You may view the Websites and download, email, share via social networking, or print individual pages from the site, in accordance with these Terms of Use and solely for your own personal, non-commercial use. You agree that in doing so, you will not remove any trademark, copyright, or other notice contained on such pages. You acknowledge that DPid may revoke permission to use the Websites in this manner at its discretion at any time for any or for no reason. Nothing on the Websites shall be construed as granting in any way any license or right to use any of the Materials or other proprietary content in any other way without the express written permission of DPid. You acknowledge that third-party service providers to which the Websites link may impose additional terms and conditions of use set forth on such third parties’ websites. Your use of any Materials provided by third parties may be subject to their additional terms and conditions of use.

Copyright and Trademark/Service Mark Notice

Unless otherwise noted, all Materials are owned, licensed, or controlled by DPid or another third party credited as the provider of the Materials. You shall not sell, license, rent, modify, copy, reproduce, distribute, display publicly, publish, edit, reverse engineer, or create derivative works from any Materials or otherwise transfer any Materials to any third person without the express written permission of DPid or the appropriate third party who provided the Materials.

Unless noted otherwise, all trademarks, service marks, domain names, and trade dress displayed on the Websites, registered and unregistered, are owned by DPid and are protected by state, federal, and international trademark laws, as well as unfair competition and other laws. DPid marks, names, logos, and trade dress include, but are not limited to, DPID, www.dpid.info, www. denture-id.com, the Websites’ trade dress, and any DPid logos. The use or misuse of these marks or any other Materials, except as permitted in these Terms of Use, is expressly prohibited.

DPid actively and aggressively enforces its intellectual property rights.

LIMITATIONS ON LIABILITY

IN NO EVENT SHALL DPID OR ITS PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR OTHER REPRESENTATIVES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OR DAMAGES WHATSOEVER THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE WEBSITES OR THE RELATED SERVICES, EVEN IF DPID HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL DPID HAVE ANY LIABILITY FOR DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY) FOR ACCESSING OR USING THE WEBSITES OR RELATED SERVICES.

DPID ASSUMES NO RESPONSIBILITY OR LIABILITY IN ANY MANNER ARISING OUT OF OR IN CONNECTION WITH ANY INFORMATION, CONTENT, PRODUCTS, SERVICES, OR MATERIAL AVAILABLE ON OR THROUGH THE WEBSITES, AS WELL AS ANY THIRD PARTY WEBSITE PAGES OR ADDITIONAL WEBSITES LINKED TO DPID.INFO, AND DENTURE-ID.COM. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. YOU ACKNOWLEDGE THAT DPID EXPRESSLY EXCLUDES LIABILITY FOR ANY SUCH INACCURACIES OR ERRORS TO THE FULLEST EXTENT PERMITTED BY LAW.

IF YOU ARE NOT SATISFIED WITH DPID OR THE RELATED SERVICES OR YOU DO NOT AGREE TO ANY PROVISIONS OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE WEBSITES AND RELATED SERVICES.

Indemnification

You agree to indemnify and hold harmless DPid, its parents, subsidiaries, affiliates, officers, directors, employees, agents, and other representatives harmless from any claim, demand, or damage, including attorneys’ fees and costs, made by anyone in connection with your use of the Websites or related services, including, but not limited to, in connection with any user content submitted by you, your violations of these Terms of Use, and any other of your acts or omissions relating to the Websites and related services.

Your Account

Use of the dental prosthetic identification services provided through the Websites require that you register and/or create an account with DPid. To register and create an account, you will use the unique identification number provided with your dental prosthetic and a temporary password the first time you visit the Websites. You must then create a unique password for future access. PLEASE NOTE: The temporary password may be used only once. YOU WILL NOT BE ABLE TO ACCESS YOUR ACCOUNT WITHOUT CREATING A UNIQUE PASSWORD THE FIRST TIME YOU VISIT.

You must also provide certain personal information. You agree to provide true, accurate, current, and complete information as prompted by the registration form on the Websites. If you provide, or if DPid has reason to suspect that you have provided, information that is untrue, inaccurate, not current, or incomplete, DPid may refuse all current or future use of the site and/or services by you.

You are solely responsible for maintaining the confidentiality and security of your account and password and for monitoring and controlling access to your account. You agree that you are fully responsible for all activities that occur under your password or account, as well as for any actions taken in connection with your account or your password. You agree to immediately notify DPid if you know of or suspect any instances of unauthorized use of your account or your password or breach of security (including the loss, theft, or unauthorized disclosure of your password or credit card information) or any other need to deactivate the password associated with your account. You agree to exit from your account at the end of each session. DPid shall not be held liable for any injury, loss, or damage of any kind arising from or relating to your failure to comply with this section of these Terms of Use, nor shall DPid be liable for any acts or omissions by you or another person using your account and/or your password.

Tier 1 Information

DPid offers Tier 1 access that is viewable as a “read only” format by anyone scanning the patient’s Data Matrix Code on either his dental prosthetic or appliance or his Identification Card AND entering a patient, Dental Practice, or Dental Laboratory Business Account password.  The dentist or dental laboratory technician may update all Tier 1 information using their Business Account password, including the patient’s name information and dental prosthetic information. DPID IS NOT RESPONSIBLE FOR A DENTIST’S OR DENTAL TECHNICIAN’S DATA ENTRY ERRORS. The intent is to keep Tier 1 data as current as possible, so information is available for the Dentist or Dental Laboratory when needed.

With prior consent from the patient, anyone who simply needs to identify ownership of the device, such as a retirement community or hospital, DPid may be contacted and when provided the patient’s Identification Number (located beneath the DPid Code), the DPid associate can provide ownership identification.

Another example would be if a dental practice or dental laboratory not in the DPid Network would need access to a patient’s dental prosthetic or appliance manufacturing data to make a repair or to remanufacture the device. In this situation, the dental practice or dental laboratory would need to contact DPid, where an associate would offer the following options:

  • The dental practice or dental laboratory could ask the patient (if available) to enter their password
  • The dental practice or dental laboratory would be offered a 1 month DPid trial subscription.
  • The dental practice or dental laboratory would indicate on the dentist’s prescription all changes to the dental prosthetic or appliance and the patient would then provide the prescription to their dentist who would then make the appropriate updates.

In an emergency situation, Emergency First Responders may scan the patient’s DPid Code attempting to obtain patient identity or possibly Pertinent Health Information.

Unfortunately the police, fire department, or EMT medical personnel WILL NOT be familiar with the DPid process nor have the patient’s password and thus WILL NOT be able to access any information, which will most likely prompt a call to DPid. The DPid associate will request the patient’s Identification Number to confirm ownership identification of the dental prosthetic or DPid Identification Card. Then the DPid associate will make every effort to assist the first responders while also maintaining patient privacy and security. In the case of an extreme emergency when time is critical, information may be released to prevent further harm to the patient.

Tier 1 information will typically include the following:

  • Patient’s first, middle, and last names;
  • Manufacture date of dental prosthetic;
  • Manufacturing country of origin of the dental prosthetic;
  • Dental Laboratory business name, address, phone, email, contact person, and if the Dental Laboratory is CDT (Certified Dental Laboratory Technician on staff), CDL (Certified Dental Laboratory), DAMAS (Dental Appliance Manufacturers Audit System) Certified Laboratory, or a State Registered Dental Laboratory;
  • Dental Practice business name, address, phone, email, dentist name, and dentist license number;
  • Notification that Pertinent Health Information is listed in the optional Tier 2 that may impact the patient due to the manufacturing materials or the procedure of inserting the dental prosthetic. Pertinent Health Information may include concerns such as allergies to certain metals or materials used in the manufacturing of a dental prosthetic or appliance, medications that may cause excessive bleeding during a dental procedure of inserting a dental prosthetic or appliance, or any health condition that a Dentist or Dental Laboratory who is unfamiliar with the patient may need to know to maintain the well-being of the patient.
  • All essential data listed on the Dental Prosthetic Categories to manufacture, repair, or remanufacture the dental prosthetic. Dental Prosthetic Categories relates to the specific type, components, and materials used to manufacture the dental prosthetic or appliance that may include the following: complete dentures, partial denture, denture gold teeth, crown & bridge, ceramic, pressable ceramic, orthodontic, implant, custom abutment, attachment, CAD/CAM, Bruxim Splint, mouth guard, sleep apnea device, and other dental prosthetics or appliances not listed. Each of these categories breaks down into specific components and materials requesting data such as: manufacturer, brand, size, type, lot number, and other data specific to that type of device. Also requested are: name of person entering data and if necessary, complaint notes, maintenance notes, and case notes.
  • If necessary, photographs of the completed dental prosthetic or appliance.

Tier 1 information is typically entered by the Dental Laboratory per the Dentist’s prescription regarding the manufacturing data of the dental prosthetic or appliance.

Tier 2 Information

DPid offers optional Tier 2 information that’s considered more sensitive than Tier 1; because of this, a higher level of security is required. This information is typically entered by the patient or trusted representative of the patient. Once the patient determines there’s a need to utilize optional Tier 2, they will be required to select and provide answers to three challenge questions of their choice from a list of predetermined questions. Tier 2 information may be accessed ONLY by first accessing Tier 1 by entering both the patient’s Identification Number and password and then answering a Tier 2 challenge question. This helps insure the security of the patient’s sensitive information by requiring them, or a trusted representative, to be involved when accessing Tier 2.

Tier 2 will typically include the following:

  • Patient’s contact information
  • Date of birth
  • Address, phone, email
  • Emergency contact information

The primary reason to have information in Tier 2, is the notification on Tier 1 that there is Pertinent Health Information listed in Tier 2 that may impact the well-being of the patient through the manufacturing materials or the procedure of inserting a dental prosthetic. Pertinent Health Information may include concerns such as allergies to certain metals or materials used in the manufacturing of a dental prosthetic or appliance, medications that may cause excessive bleeding during a dental procedure of inserting a dental prosthetic or appliance, or any health condition that a Dentist or Dental Laboratory who is unfamiliar with the patient may need to know to maintain the well-being of the patient.

Because of the sensitive nature of Tier 2 information, it is optional, and DPid recommends the patient or trusted representative of the patient take the responsibility to enter and update the information.

The intent of Pertinent Health Information in Tier 2 is for it to include ONLY information as it relates to health-related concerns that may impact the well-being of a patient through the manufacturing materials or procedure of inserting a dental prosthetic. It is not intended to contain Personal Health Records (PHR) of the patient that has no impact on the work being done by the Dentist or Dental Laboratory. Personal Health Record (PHR), similar to Electronic Health Record (EHR), Electronic Patient Record (EPR), or Electronic Medical Record (EMR) is typically generated and maintained within an institution such as a hospital, clinic, and physician’s office, to give patients, physicians and other health care providers, and payers or insurers access to patient’s medical records across facilities.  The patient or trusted representative of a patient agrees NOT to list or disclose any HIV/AIDS medical information under Pertinent Health Information.  If a patient or trusted representative of a patient is uncertain about what, if any, Pertinent Health Information needs to be entered, DPid strongly suggests they consult with their Dentist or Dental Laboratory.

Only if Pertinent Health Information is entered in Tier 2 will an icon automatically appear as an alert in Tier 1. If a Pertinent Health Information icon appears in Tier 1, the dentist or dental laboratory technician, after gaining authorized access to the patient’s Tier 1 information, can click on the icon to view the patient’s Pertinent Health Information. The dentist and dental laboratory technician have ONLY viewing access to the Pertinent Health Information and do NOT have access to any other Tier 2 information.

Only in the case of extreme emergencies will Tier 2 information be provided to medical or law enforcement first responders without providing the necessary correct answers to the challenge questions.

Use of the Websites

You agree that your use of the Websites and related services is subject to and shall comply with all applicable local, state, and federal laws and regulations. You further agree that you will not engage in any use prohibited by these Terms of Use.

In using the site and related services, you agree:

  • To comply with all applicable local, state and federal laws, regulations and rules;
  • Not to use the Websites if you are under the age of 13 (Parents or guardians are solely responsible for supervising minors’ use of the Websites);
  • Not to access the Websites using a third party’s account;
  • Not to use the Websites or related services for illegal purposes;
  • Not to interfere with any other person’s use and enjoyment of the Websites or related services;
  • Not to attempt to gain unauthorized access to other computer systems from or through the Websites;
  • Not to upload or transmit viruses or other harmful, disruptive or destructive files or disrupt, interfere with, or otherwise harm or violate the security of the Websitesor any services, system resources, accounts, passwords, servers or networks connected to or accessible through the Websites; and
  • Not to engage in any other activity prohibited by these Terms of Use.

Operation of the Websites and/or Services

DPid reserves the right, in its sole option and discretion, to modify, suspend, or discontinue at any time, with or without notice, the Websites and/or the services offered through the Websites. Your right to use the Websites and services will end if your account is terminated.

Miscellaneous

Survival; Assignment – Any rights or obligations contained in these Terms of Use that by their nature should survive termination of your use of the Websites or DPid’s services shall survive, including, but not limited to, representations, warranties, intellectual property rights, and indemnity obligations.

DPid may, without notice, assign its rights and duties under these Terms of Use to any party at any time.

Legal and Equitable Relief –DPid reserves the right to seek all remedies available at law and in equity for violations of these Terms of Use. In the event of any violation or threatened violation of these Terms of Use, DPid shall be authorized and entitled to obtain, from any court of competent jurisdiction, preliminary and permanent injunctive relief as well as an equitable accounting of all profits or benefits arising out of such violation, which right and remedies shall be cumulative and in addition to any other rights or remedies to which DPid may be entitled. DPid reserves the right to block access to the site from a particular Internet address.

Severability – If any provision or part of any provision of these Terms of Use is found to be invalid or unenforceable by any court or other competent body, that provision or part shall be enforced to the maximum extent permissible and such invalidity or unenforceability shall not affect the other provisions (or parts thereof) of these Terms of Use, and such other provisions (and parts thereof) shall remain in full force and effect.

Waiver – If DPid fails to exercise a right or remedy that it has or that arises in relation to these Terms of Use, such failure shall not prevent DPid from exercising that right or remedy subsequently in respect of that or any other incident. A waiver of any breach or provision of these Terms of Use shall be effective only if it is made in writing and signed on behalf of DPid. Any waiver of a breach of any provision of these Terms of Use shall not be deemed a waiver of any subsequent breach and shall not affect the enforceability of any other provision of these Terms of Use.

The provisions of these Terms of Use shall not be modified by the course of conduct between the parties nor by trade practice.

Governing Law –These Terms of Use and all matters arising out of them shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to principles of conflicts of laws. You agree that any disputes arising out of these Terms of Use shall be determined by the federal and state courts of the Commonwealth of Pennsylvania.
